This document concerns the use of oem-motordecals.com. Sales, delivery, returns and complaints are governed separately, by the shop Terms and Conditions.
§ 1What this document covers
- The site oem-motordecals.com is operated by MOTOR DECALS BEATA KIZIUKIEWICZ, ul. Słowiańska 17, 75-846 Koszalin, Poland.
- These terms concern the use of the website: browsing the catalogue, searching for parts, using the forms and sending us messages.
- The conclusion and performance of sales contracts is governed by the shop Terms and Conditions, and the processing of personal data by the Privacy Policy. If this document and the Terms and Conditions differ, matters of sale are decided by the Terms and Conditions.
§ 2Information about parts and their fitment
- The catalogue identifies parts by the manufacturer number (OEM or MPN). It is the number, not the name or the photograph, that identifies a part unambiguously.
- Lists of models and years ("fits") and reference drawings are an aid to searching. Manufacturers change numbers during production and the same model is sometimes offered in versions differing in detail, so before ordering it is worth comparing the part number with the number on the vehicle or in the manufacturer catalogue.
- Photographs and drawings may show the part in a colour or variant other than the one ordered, where this is clearly stated with the product.
- The above is information to help you choose. It does not limit the seller liability for conformity of the goods with the contract - if the part you receive does not match the description on the site, the shop Terms and Conditions apply.
§ 3Links to external sites
- The site may contain links to services run by other entities. We include them for convenience and they do not mean that we recommend their content.
- We have no influence over content published on external services and are not responsible for it. Using them is subject to the terms set by their owners.
§ 4Content on the site and content you send us
- Descriptions, photographs, drawings and the layout of the site are protected by copyright. You may use them for your own purposes; commercial use requires our consent.
- If you send us content - a message, a photograph for a complaint, a review - we use it solely for the purpose for which it was sent: handling your case, or publishing a review with the product if you post one yourself.
- We do not pass such content to anyone for marketing purposes and we do not change its meaning. You may ask at any time for a review you posted to be removed.
§ 5Prohibited use
- You must not disrupt the operation of the site, circumvent its protections, download the catalogue by automated means for your own sales, or impersonate others.
- We may restrict access to the site for anyone breaching the above, to the extent and for the time needed to stop the breach.
§ 6Liability
- We take care that the site works without interruption and that the information on it is current, but we cannot guarantee the absence of technical breaks or errors in the content.
- Towards consumers we do not limit our liability beyond what the law permits. Rights concerning conformity of goods with the contract and the right of withdrawal are set out in the shop Terms and Conditions and nothing in this document reduces them.
- Towards customers who are not consumers, our liability for use of the site is limited to actual loss and does not cover loss of profit.
§ 7Changes to these terms
- We may change these terms for valid reasons: changes in the law, changes to the functions of the site, or the need to remove ambiguities.
- We publish the new text on the site with the date. Merely visiting the site does not mean agreement to a change - the amended terms apply to use of the site after they are published.
- These terms apply from the day they are published on the site.
§ 8Applicable law and courts
- Polish law applies to the use of the site. This choice does not deprive a consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
- Disputes with a consumer are heard by the court having jurisdiction under general rules.
- Disputes with a customer who is not a consumer are heard by the court for the registered office of the site operator.
